Lifetime Consumer Limited Warranty

 

 

 

WHAT IS WARRANTED AND FOR HOW LONG?

When installed as part of an indoor shower enclosure and maintained according to Guardian Europe SARL’s (“Guardian”) cleaning recommendations (available for download on www.showerguardglass.com), Guardian warrants to the Original End-user Customer that ShowerGuard glass will be free from visible staining, corrosion, or discoloration under normal use for as long as the Original End-user Customer owns the residence or other property at which the shower enclosure is installed (“Limited Warranty”). This Limited Warranty does not cover defects related to the processing or the installation of the glass. Liability under this Limited Warranty is limited, at Guardian’s exclusive option, to Guardian furnishing replacement ShowerGuard glass or refunding the difference in the Original End-user Customer’s purchase price between ShowerGuard glass and standard glass, up to a maximum of € 80.00 per square meter. If Guardian furnishes replacement ShowerGuard glass under this Limited Warranty, the warranty coverage will extend to the replacement glass.

 

 

WHO IS COVERED?

Except where prohibited by applicable laws, this Limited Warranty extends only to the Original End-user Customer and is non-transferable. “Original End-user Customer” means the original end purchaser of the ShowerGuard product who installs the product in the purchaser's property (owned or rented), or the original end user who contracts through a remodeler or contractor for the original purchase and installation of the ShowerGuard product in the original end -user’s property (owned or rented), or the first buyer of a property that contains the ShowerGuard product as a new installation. This Limited Warranty applies to ShowerGuard products purchases after January 1, 2010 in the European Union, as well as in the countries outside of the European Union where ShowerGuard products may be sold. HOW TO MAKE A CLAIM

To make a claim under this Limited Warranty, a covered customer, having activated this Limited Warranty through its registration or by mail, must contact its shower dealer or ShowerGuard Customer Service, Guardian Europe SARL, Z.I. Wolser, L-3452 Dudelange, G.D. Duchy of Luxembourg, and provide: proof of original purchase showing date and price paid; description of defect; and the name of the retailer or dealer from whom the glass was purchased. Guardian must authorize any product returns.

 

 

LIMITATIONS

This Limited Warranty only becomes valid upon registration within 180 days of the original purchase date. This Limited Warranty does not cover scratches, chips, breakage, or claims for glass that has been discarded or destroyed before an authorized Guardian representative has inspected it. This Limited Warranty does not cover defects related to the processing or the installation of the glass. This Limited Warranty is void if the ShowerGuard glass is damaged by accident, improper use, failure to follow Guardian recommended cleaning, installation, or handling procedures, or other causes outside Guardian’s control, or if the product is altered in any way. This Limited Warranty does not cover labour charges or other costs relating to removal or reinstallation of either the original ShowerGuard glass or replacement glass.
To the maximum extent permitted by law, and except for this Limited Warranty, Guardian disclaims all express and implied warranties of any kind including with respect to merchantability or fitness for particular purpose. Where permitted by law, Guardian further disclaims any liability for any direct, indirect, special, incidental or consequential loss or damage incurred by the Original End-user Customer and resulting from Guardian products or from information supplied to the Original End-user Customer by Guardian or by a supplier. Guardian disclaims all liability for any act of a supplier and its employees or any loss incurred by the Original End-user Customer as a result of any supplier.

 

 

YOUR RIGHTS UNDER APPLICABLE LAW

This Limited Warranty does not affect or prejudice in any way any legal (statutory) rights that you may have under applicable national laws relating to the sale of consumer products.

 

 

REGISTERING AND ACTIVATING THIS LIMITED

To activate this Limited Warranty, please register it within 180 days of purchase online on this Warranty Registration page or by mail to the following address: Guardian Europe SARL, 19 rue du Puits Romain, L-8070 Bertrange, G.D. of Luxembourg. To register the Limited Warranty, you need the unique code number which you may find on the Certificate of Authenticity or on the stamp affixed to the shower enclosure.

 

 

PRIVACY

Guardian Europe SARL, 19 rue du Puits Romain, L-8070 Bertrange, G.D. of Luxembourg requires the customer’s data for purposes of registering and maintaining the Limited Warranty and has the right to save and use it for that purpose. Guardian may transfer the data to its affiliates and service companies where necessary to register and maintain the Limited Warranty. The data will be used exclusively for these purposes and will be processed in accordance with applicable law. It is understood that the customer has the right to access and correct the personal data by contacting Guardian at ShowerGuardSupport@guardian.com in order to exercise those rights.
